First International Day of Remembrance and Dignity for Genocide Victims

On this the very first ‘International Day of Commemoration and Dignity of the Victims of the Crime of Genocide and of the Prevention of this Crime’, the global network of justice activists and experts International Crimes Strategy Forum (ICSF) pays tribute to all victims of genocide all over the world, and in particular to the victims of Bangladesh genocide in 1971.

ICSF takes this occasion to remember as well as to remind the global community that during the 9 months of occupation of the invading Pakistani armed forces that led to the all out Liberation War of Bangladesh in 1971, Pakistan military and its auxiliary paramilitary forces were involved in elimination of 3-million Bengalees, and rape of more than 200,000 women as part of a military blueprint that devised sexual violence as a weapon of war against the Bengalee civilians. The marauding army’s genocide forced 10 million civilians to take refuge in neighbouring India, and around 30 millions to be internally displaced.

The victims of 1971 war had to wait over 40 years for any form of redress and only in 2010 Bangladesh initiated a domestic process to investigate and prosecute the perpetrators for international crimes, starting with the trial of the local perpetrators, while the international community continually failed to deal constructively with what is known as one of the gravest human rights tragedies of the last century.

The pathological failures of international community in the case of Bangladesh genocide also include – its failure to support and provide technical assistance to the justice process, even when sought by the Government of Bangladesh, as well as its inclination to be swayed by distorted narratives deliberately advanced by the vested lobbyists and PR agents working on behalf of the accused individuals. It is exactly the context such as this that allowed the members of the Pakistani armed forces and other Pakistani citizens involved in international crimes to escape justice so far. They must be brought to justice, and it is imperative that the international community stands by the victims, and strengthens and supports the people of Bangladesh in their quest towards ending impunity and establishing rule of law.

In solidarity with the United Nations for proclaiming this special day of observance, ICSF expresses hope that the significance of the day will not be lost on the international community, as the day also coincides with the anniversary of the adoption of the Convention on the Prevention and Punishment of the Crime of Genocide in 1948. We echo what Adama Dieng, the United Nations Special Adviser on the Prevention of Genocide, said while welcoming the adoption of UN General Assembly Resolution that proclaimed this day: “Remembering the events of the past and paying tribute to those who perished should strengthen our resolve to prevent such events from ever happening again”.

প্রসঙ্গ: জাতিসংঘ ঘোষিত প্রথম আন্তর্জাতিক গণহত্যা স্মরণ ও প্রতিরোধ দিবস

আজ ৯ ডিসেম্বর প্রথমবারের মত জাতিসংঘ ঘোষিত গণহত্যা স্মরণ, প্রতিরোধ, এবং গণহত্যায় নিহত ক্ষতিগ্রস্তের মর্যাদা রক্ষায় আন্তর্জাতিক দিবস পালিত হচ্ছে। এই বিশেষ দিনটিকে সামনে রেখে গণহত্যা ও যুদ্ধাপরাধ ইস্যুতে, এবং বিশেষ করে ১৯৭১ এর যুদ্ধাপরাধীদের বিচার ইস্যুতে, বিশ্বব্যাপী সক্রিয় বিশেষজ্ঞ পেশাজীবি এবং স্বেচ্ছাসেবী একটিভিস্টদের সংগঠন –  ইন্টারন্যাশনাল ক্রাইমস স্ট্র্যাটেজি ফোরাম (আইসিএসএফ) এ পর্যন্ত পৃথিবীর বিভিন্ন প্রান্তে সংঘটিত সকল গণহত্যায় নিহত ও ক্ষতিগ্রস্তদের স্মরণ করছে এবং গভীর শ্রদ্ধা নিবেদন করছে।

এই তাৎপর্যপূর্ণ দিবসটিতে আইসিএসএফ আন্তর্জাতিক সম্প্রদায়কে আবারও স্মরণ করিয়ে দিতে চায় – বাংলাদেশে ১৯৭১ সালের মুক্তিযুদ্ধ চলাকালীন নয় মাসে আগ্রাসী পাকিস্তান সামরিক বাহিনীর দখলদারিত্বের কথা, যখন পাকিস্তানী সামরিক বাহিনী এবং তাদের স্থানীয় দোসর আধা-সামরিক রাজাকার-আলবদর-আলশামস বাহিনীর হাতে হত্যার শিকার হয়েছিলেন তিরিশ লক্ষ বাঙ্গালী। তাদের সামরিক নীলনকশার বাস্তবায়নে ধর্ষিত হয়েছিলেন অন্তত দুই লক্ষ নারী। বেসামরিক জনগনের বিরুদ্ধে যৌন সহিংসতাকে সমর কৌশল হিসেবে প্রয়োগ করেছিল এই অপরাধী চক্র। তাদের নিপীড়নের হাত থেকে রক্ষা পেতে অন্তত এক কোটি মানুষ প্রতিবেশী দেশ ভারতে পালিয়ে গিয়ে আশ্রয় নিতে বাধ্য হয়েছিলেন, আভ্যন্তরীণভাবে বাস্তুচ্যুত হয়েছিলেন আরও তিন কোটি মানুষ।

১৯৭১ সালের গণহত্যার শিকার এবং ক্ষতিগ্রস্ত ব্যক্তিদের স্বীকৃতি এবং বিচার পেতে অপেক্ষা করতে হয়েছে দীর্ঘ চল্লিশ বছর। অবশেষে ২০১০ সাল থেকে বাংলাদেশের মাটিতে ১৯৭১-এ সংঘটিত আন্তর্জাতিক অপরাধগুলোর তদন্ত ও বিচার শুরু হয়েছে পাকিস্তান সেনাবাহিনীর দোসরদের বিচারের মুখোমুখি করার মধ্য দিয়ে, একটি আভ্যন্তরীণ বিচারিক প্রক্রিয়ার অংশ হিসেবে।

১৯৭১ এর এই গণহত্যা বিগত শতাব্দীর জঘন্যতম একটি মানবাধিকার লঙ্ঘনের ঘটনা হওয়া সত্ত্বেও আমরা লক্ষ্য করেছি এর মোকাবিলায় বাংলাদেশের গণহত্যার বিচার কিংবা ভিকটিমদের পাশে এসে দাঁড়ানোর ক্ষেত্রে তথাকথিত আন্তর্জাতিক সম্প্রদায়ের লাগাতার ব্যার্থতা। যুদ্ধাপরাধের অভিযোগে অভিযুক্ত ব্যক্তিবর্গের পক্ষে কাজ করা ভাড়াটে লবিস্ট এবং জনসংযোগ প্রতিষ্ঠানগুলোর অপতৎপরতায় প্রভাবিত হয়ে ত্রুটিপূর্ণ তথ্য, আখ্যান, ও বিশ্লেষণ দ্বারা পক্ষপাতদুষ্ট হতে দেখেছি আমরা এই আন্তর্জাতিক সম্প্রদায়েরই নাম করা সব প্রতিষ্ঠানকে। এমনকি বিচার শুরুরও আগে প্রস্তুতিলগ্নে বাংলাদেশ সরকারের পক্ষ থেকে যখন কারিগরি এবং কৌশলগত সাহায্য চাওয়া হয়েছিল জাতিসংঘসহ এই বিভিন্ন আন্তর্জাতিক প্রতিষ্ঠানের কাছে, তখনও এই সব অপতৎপরতার সরাসরি ফল হিসেবে বাংলাদেশের এই বিচার প্রক্রিয়াকে সাহায্যবঞ্চিত করার পন্থাই বেছে নিয়েছিল এই আন্তর্জাতিক সম্প্রদায়।

বাংলাদেশের গণহত্যার ক্ষেত্রে আন্তর্জাতিক সম্প্রদায়ের এই নেতিবাচক ভূমিকা কেবল ভয়াবহ গণহত্যার ভিকটিমদের সাথে বিশ্বাসঘাতকতাই ছিল না, তাদের এই অবস্থানের কারণেই এতো বছর ধরে পাকিস্তানী সামরিক বাহিনীর চিহ্নিত অপরাধীরা এবং তাদের সাথে সংশ্লিষ্ট অন্যান্য পাকিস্তানী নাগরিকরা বিচার এড়িয়ে যেতে পেরেছে। ১৯৭১ সালের গণহত্যায় দায়ী এবং অভিযুক্ত পাকিস্তানী নাগরিকদের অবশ্যই বিচারের মুখোমুখি করতে হবে। সেই লক্ষ্যকে সামনে রেখে নিহত এবং ক্ষতিগ্রস্তদের পাশে দাঁড়ানো, বাংলাদেশে চলমান বিচারের পক্ষের কর্মকান্ডকে শক্তিশালী করা, বিচারহীনতার সংস্কৃতির নিরসনের মাধ্যমে আইনের শাসন প্রতিষ্ঠায় ভূমিকা রাখা, সর্বোপরি বাংলাদেশের মানুষের পাশে দাঁড়ানো এখন আন্তর্জাতিক সম্প্রদায়ের অবশ্য পালনীয় কর্তব্য।

গণহত্যা স্মরণ ও প্রতিরোধে ঘোষিত এই আন্তর্জাতিক দিবসটি এমনই এক দিনে ধার্য্য করা হয়েছে যে দিনটিতে ১৯৪৮ সালে জাতিসংঘে গণহত্যা প্রতিরোধ এবং শাস্তি সম্পর্কিত আন্তর্জাতিক কনভেনশন গৃহীত হয়েছিল। তাই আইসিএসএফ আশা করে বিশেষ এই দিনটির এই দ্বৈত তাৎপর্য আন্তর্জাতিক সম্প্রদায় কখনো বিস্মৃত হবে না। এ বছরের সেপ্টেম্বর মাসে – এই বিশেষ দিবস ঘোষণার জন্য জাতিসংঘের সাধারণ পরিষদে গৃহীত প্রস্তাবকে স্বাগত জানিয়ে দেওয়া আদামা ডিয়েং (জাতিসংঘের গণহত্যা প্রতিরোধবিষয়ক বিশেষ উপদেষ্টা) এর বক্তব্যের সাথে একাত্ম হয়ে আইসিএসএফ-ও মনে করে: “অতীতের ঘটনাবলীর স্মরণ এবং নিহতদের প্রতি শ্রদ্ধাজ্ঞাপন এসব ঘটনার পূনরাবৃত্তি প্রতিরোধে আমাদের সংকল্পকে আরও দৃঢ় করবে।”
