Amendments to the country’s constitution since 1973 contributed little to fortify it, rather many changes made with ulterior motives largely destroyed its basic features.

The most fundamental, and in some cases nefarious, of those changes were brought through the fourth, fifth, seventh, and eighth amendments.

Prime Minister Sheikh Hasina’s categorical statement to her cabinet colleagues that her government has no intention of banning region-based political parties should set at rest all speculation about it in the wake of the HC’s invalidation of the fifth amendment. What particularly strikes a responsive chord in all right-thinking people keeping welfare of the nation upper most in their mind is her reasoning behind her decision. Her argument is that if banned, politics of such denomination would go underground. She sagaciously visualises that when driven underground such politics could acquire all clandestine implications with portents for wreaking havoc on national psyche, let alone fuelling militancy.

সংবিধানের পঞ্চম সংশোধনী বাতিল করে দেয়া সুপ্রিম কোর্টের রায় পর্যালোচনা করছে বিএনপি। বিরোধী দলীয় নেত্রী ও বিএনপি চেয়ারপারসন বেগম খালেদা জিয়া দলের কৌশল নির্ধারণ করতে বিএনপি ও জামায়াতপন্থি সিনিয়র আইনজীবীদের সাঙ্গে রুদ্ধদ্বার বৈঠক করেছেন রবিবার রাতে। গুলশান কার্যালয়ে রাত পৌনে ১০টা থেকে রাত ১২টা পর্যন্ত এই বৈঠক চলে।

The Supreme Court of Bangladesh has reinstated the measure banning Islamic parties. In a document of 184 pages presented July 26 last, the Court has demolished the Fifth Amendment of the 1979Constitution, including provisions that allowed the rise of Islamic parties in parliament during military regimes (1975 – 1979, 1982 – 1990). The measure, introduced for the first time in January, has been blocked for six months because of an appeal process demanded by Islamic leaders.

Despite having the mandate from the Supreme Court, the government yesterday decided in principle that it would not ban any religion-based political party.

The SC in its landmark verdict gave the government the mandate to ban religion-based political parties. Prime Minister Sheikh Hasina, however, categorically told her cabinet colleagues that her government would not ban any such party since banning them could make them take up underground politics and create trouble in the country.

সংবিধানের পঞ্চম সংশোধনী সংক্রান্ত সুপ্রিম কোর্ট আপিল বিভাগের রায় কি পদ্ধতিতে সংবিধানে সংযোজিত করা হবে এ নিয়ে আইন ও সংবিধান বিশেষজ্ঞদের মধ্যে বিতর্ক সৃষ্টি হয়েছে। এদের একাংশ মনে করেন, আদালতের রায় হুবহু ছাপিয়ে তা প্রকাশ করতে হবে। এ প্রসঙ্গে সংবিধান বিশেষজ্ঞ ড. কামাল হোসেন ও হাইকোর্টের অবসরপ্রাপ্ত বিচারক বিচারপতি সৈয়দ আমিরুল ইসলাম বলেছেন, আদালতের রায়ের সঙ্গে সঙ্গে সংবিধানের সংশ্লিষ্ট অনুচ্ছেদগুলো পুনরুজ্জীবিত হয়ে গেছে। এখন সরকারকে বিজি প্রেসের মাধ্যমে ছাপিয়ে তা প্রকাশ করতে হবে। অপরাংশ মনে করেন, রায় পরীক্ষা-নিরীক্ষার এখতিয়ার সংসদের। এ প্রসঙ্গে বিশিষ্ট পার্লামেন্টারিয়ান সালাহউদ্দিন কাদের চৌধুরী বলেছেন, সংবিধানের ১৪২ অনুচ্ছেদ অনুযায়ী সংবিধান সংশোধনের একমাত্র এখতিয়ার সংসদের।

বাংলাদেশে ধর্মভিত্তিক বা ধর্মীয় রাজনৈতিক দল সাংবিধানিকভাবে নিষিদ্ধ হোক তা আমি চাই না; কিন্তু জামায়াতে ইসলামী দলটিকে নিষিদ্ধ করা হোক তা চাই। কথাটা শুনে আমার অনেক বিজ্ঞ পাঠক হয়তো হৈ চৈ করে উঠবেন, বলবেন, ধর্মভিত্তিক রাজনৈতিক দল বাংলাদেশে নিষিদ্ধ হোক তা চান না, অথচ জামায়াত নিষিদ্ধ হোক তা চান এটা কি পরস্পরবিরোধী কথা হয়ে গেলো না? কথাটা পরস্পরবিরোধী শোনায়, কিন্তু পরস্পরবিরোধী নয়।

Leaders of Ekatturer Ghatak Dalal Nirmul Committee urged the government to immediately cancel the 8th constitutional amendment containing the words ‘Islam as state religion’. This is in the light of recent Supreme Court judgement that scrapped the 5th amendment, says a press release yesterday.

সংবিধানের পঞ্চম সংশোধনী সম্পর্কে সুপ্রিম কোর্টের রায় এবং সংবিধান সংশোধনে সংসদীয় বিশেষ কমিটি গঠনের বিষয়টি প্রধান বিরোধী দল বিএনপি পর্যবেক্ষণ করছে। সংবিধানে ‘বিসমিল্লাহির রহমানির রাহিম ও বাংলাদেশী জাতীয়তাবাদ’ রাখা হলে বিএনপি কিছু করবে না। তবে অপরাপর বিষয়ে প্রতিক্রিয়া জানাবে। বিএনপি’র স্থায়ী কমিটির সদস্য নজরম্নল ইসলাম খান ইত্তেফাককে বলেন, বিএনপিতে যারা সংবিধান বিশেষজ্ঞ তারা বিশিষ্ট আইনজীবীদের নিয়ে আজ-কালের মধ্যে বৈঠক করে করণীয় সম্পর্কে দলের চেয়ারপার্সনকে অবহিত করবেন।

সামরিক শাসক এইচ এম এরশাদের ক্ষমতা গ্রহণের ব্যাপারে সংবিধানের ৭ম সংশোধনী সংক্রান্ত রিট মামলার রুলের জবাব চলতি সপ্তাহে উচ্চ আদালতে দাখিল করা হচ্ছে। পঞ্চম সংশোধনী নিয়ে সম্প্রতি আপিল বিভাগের দেয়া রায়ের আলোকে এই রুলের জবাব দেবে সরকার।
