A three member panel of International Crimes Strategy Forum (ICSF) recently presented three papers on the International Crimes Tribunal of Bangladesh (ICT-BD) at the Sixth Annual YCC Global Conference. Organized by the Younger Comparativists Committee (YCC) of the American Society of Comparative Law, the conference took place at the Koç University Law School in Istanbul, Turkey between April 28-29, 2017 bringing together over 100 scholars from all over the world.

The purpose of the conference was to highlight, develop, and promote the scholarship of new and younger comparativists in a diverse range of legal topics. The exclusive ICSF panel was titled ‘International Crimes Tribunals (ICTs) of Bangladesh Through the Prism of Comparative Law’ and was chaired by Dr Işık Önay, a member of faculty at the Koç University Law School.

ICSF Trustee Dr Rayhan Rashid presented the first paper titled: ‘Prescription versus Obligation to Import Foreign Norms: The Case of the ICTs of Bangladesh.’ Bahzad H. Joarder, a graduate of the University of Birmingham presented the second paper titled ‘Prosecuting Crimes Against Humanity at the ICTs of Bangladesh.’ M Sanjeeb Hossain, a Trustee of ICSF and Doctoral Candidate of the Warwick Law School, presented the third paper titled: ‘Trials in absentia at the ICTs of Bangladesh: Jurisprudence and Commentary’. It is worth mentioning that all three presenters were supported by scholarships offered by the American Society of Comparative Law and Koç University.

Founded in 1951, the American Society of Comparative Law is the world’s premier organization relating to study of comparative law. Given the reputation of the organizers and the participants, this was a very important opportunity for ICSF to present the case of the ICT-BD to a diverse international audience, especially given the level of misinformation and misconception spread against this justice process by those opposed to it. During the course of the conference, and especially during the presentations, a number of misconceptions were cleared, while important clarifications on the justice process were provided on prevalent confusions.

ICSF is an independent global network of academics, experts and activists working in the interest of justice for the victims of international crimes and has long campaigned for the recognition of the Bangladesh Genocide and holding trials of its perpetrators.

বাংলাদেশের বিচার প্রক্রিয়া নিয়ে ওয়াইসিসি সম্মেলনে আইসিএসএফ এর ৩-টি প্রবন্ধ উপস্থাপন

সম্প্রতি ইন্টারন্যাশনাল ক্রাইমস স্ট্রাটেজি ফোরাম (আইসিএসএফ) এর তিন সদস্যের একটি প্যানেল ষষ্ঠ ওয়াইসিসি বৈশ্বিক সম্মেলনে আন্তর্জাতিক অপরাধ আদালত (আইসিটি-বিডি) এর বিচার প্রক্রিয়ার ওপর তিনটি প্রবন্ধ উপস্থাপন করে। তুরষ্কের কচ্ বিশ্ববিদ্যালয়ে অনুষ্ঠিত এবং আমেরিকান সোসাইটি অফ কমপারেটিভ ল এর ইয়ংগার কমপ্যারাটিভিস্ট কমিটি আয়োজিত এই সম্মেলন অনুষ্ঠিত হয় এপ্রিলের ২৮ ও ২৯ তারিখে। এই সম্মেলনে বিশ্বের বিভিন্ন প্রান্ত থেকে ১০০ জনেরও বেশি আইনজ্ঞ, গবেষক ও বিশেষজ্ঞরা সামিল হয়েছিলেন।

এই সম্মেলনের উদ্দেশ্য ছিল তুলনামূলক আইনে আগ্রহী তরুণ আইনবিদদের মধ্যে প্রাসঙ্গিক বিভিন্ন ক্ষেত্রে বিশেষ আলোকপাত ও মত বিনিময়ের পরিসর তৈরী করা। কচ্ বিশ্ববিদ্যালয় আইন অনুষদের পক্ষ থেকে ড. ইসিক ওনেয় আইসিএসএফ এর বিশেষ প্যানেলটির সভাপতিত্ব করেন, যার শিরোনাম ছিল – “তুলনামূলক আইনের আঙ্গিকে বাংলাদেশের আন্তর্জাতিক অপরাধ আদালত” – যেখানে তিনটি প্রবন্ধই ছিল বাংলাদেশে ১৯৭১ এর যুদ্ধাপরাধ বিচার প্রক্রিয়া নিয়ে।

“ভিনদেশী বিধি আমদানীর বিধান বনাম বাধ্যকতা: আইসিটি বাংলাদেশ পরিপ্রেক্ষিত” শিরোনামে প্রথম প্রবন্ধটি উপস্থাপন করেন আইসিএসএফ ট্রাস্টি ড. রায়হান রশিদ। “বাংলাদেশে মানবতার বিরদ্ধে অপরাধের বিচার” শীর্ষক দ্বিতীয় প্রবন্ধটি উপস্থাপন করেন বার্মিংহাম বিশ্ববিদ্যালয়ের স্নাতক বাহজাদ জোয়ারদার। তৃতীয় প্রবন্ধ উপস্থাপন করেন যুক্তরাজ্যের ওয়ারউইক আইন বিশ্ববিদ্যালয়ের পিএইচডডি গবেষক এম সানজিব হোসেন, যার শিরোনাম ছিল – “আইসিটি বাংলাদেশে ব্যক্তির অনুপস্থিতিতে বিচারঃ আইন ও ব্যাখ্যা” এই শিরোনামে। উল্লেখ্য, আইসিএসএফ প্যানেলের তিনজন সদস্যই আমেরিকান সোসাইটি অফ কমপারেটিভ ল এবং কচ্ বিশ্ববিদ্যালয় থেকে প্রাপ্ত বৃত্তিতে সম্মেলনে অংশগ্রহণ করেন।

১৯৫১ সালে প্রতিষ্ঠিত আমেরিকান সোসাইটি অফ কমপারেটিভ ল তুলনামূলক আইন বিষয়ে বিশ্বের প্রথম সারির সংগঠনগুলোর একটি। খ্যাতিমান আয়োজক আর বহুজাতিক এই সমাবেশে আইসিটি বাংলাদেশ এবং সার্বিক বিচার প্রক্রিয়াকে উপস্থাপন করা ছিল আইসিএসেফ এর লক্ষ্য, বিশেষ করে যখন এই বিচারের বিরোধীরা তথ্য বিভ্রাট ও বিকৃতির মাধ্যমে বিশ্বের সামনে আইসিটি বাংলাদেশকে প্রশ্নবিদ্ধ করার কাজে তৎপর। আইসিএসএফ এর তিনটি প্রবন্ধের মাধ্যমে বাংলাদেশের বিচার প্রক্রিয়া নিয়ে প্রচলিত বিভ্রান্তিগুলোর সঠিক জবাব ও গুরুত্বপূর্ণ ব্যাখ্যা তুলে ধরা হয়।

আন্তর্জাতিক অপরাধের ভিক্টিমদের ন্যায়বিচার প্রদানের লক্ষ্যে কর্মরত শিক্ষাবিদ, গবেষক, বিশেষজ্ঞ এবং কর্মীদের সমন্বয়ে গঠিত ইন্টারন্যাশনাল ক্রাইমস স্ট্রাটেজি ফোরাম (আইসিএসএফ) একটি স্বাধীন বৈশ্বিক নেটওয়ার্ক যা দীর্ঘদিন ধরে বাংলাদেশে সংগঠিত গণহত্যার স্বীকৃতি আদায় ও অপরাধীদের বিচারের আওতায় আনার লক্ষ্যে কাজ করে চলেছে।
